1. Agreement to these terms

These Terms of Service govern your use of ShopYoungAmerican.com and any related services offered by Young American. In these Terms, “Young American,” “we,” “us,” and “our” refer to Young American. “You” refers to anyone who visits the website, creates an account, or places an order.

By accessing our website or purchasing from us, you agree to these Terms of Service and to our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree to these terms, please do not use the website.

When another Young American policy addresses a particular issue more specifically, that policy will control for that issue.

2. Eligibility and customer accounts

You must be at least the age of majority in your state of residence to place an order. If you are under that age, a parent or legal guardian must place the order on your behalf.

If you create a customer account, you are responsible for keeping your login information secure and for activity conducted through your account. Information supplied through your account must be current, complete, and accurate.

3. Shopify’s role

Our store is hosted by Shopify, which provides the ecommerce platform used to display products and process orders. Purchases made through the store are transactions directly between you and Young American. Shopify is not the seller of our products and is not responsible for fulfilling or resolving your order.

4. Products and product information

We make reasonable efforts to present product descriptions, photographs, colors, measurements, and other information accurately. However, colors can appear differently depending on your screen, lighting, and device settings.

Because our products are made to order, minor variations in print appearance, placement, color, and garment measurements may occur. These normal production variations are not necessarily defects. Nothing in this section limits coverage for genuinely damaged, defective, misprinted, or incorrect items under our Return and Refund Policy.

Product availability is not guaranteed. We may modify or discontinue products, colors, sizes, designs, or other options at any time before an order is placed.

5. Prices, taxes, and payment

All prices are listed in U.S. dollars unless otherwise stated. Prices may change without notice, but a price change will not affect an order that we have already accepted.

Applicable taxes, shipping charges, discounts, and the final order total are displayed during checkout.

You agree to provide current, complete, and accurate billing and payment information. By submitting an order, you represent that you are authorized to use the selected payment method and authorize the applicable charges.

6. Orders

Submitting an order does not guarantee that we can accept or fulfill it. We may reject, limit, or cancel an order for legitimate reasons, including:

Payment authorization problems
Suspected fraud or unauthorized activity
Incorrect product or pricing information
Product or material unavailability
Shipping restrictions
An inability to fulfill the order as submitted
A violation of these Terms

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

We may contact you using the email address or telephone number provided with your order if additional information is needed.

7. Made-to-order products, cancellations, and returns

Young American products are made to order and can enter production quickly.

Requests to change or cancel an order must be made immediately. An order can be changed or canceled only before production begins, and submitting a request does not guarantee that the change or cancellation will be possible.

Once production has begun, the order cannot be changed or canceled.

Returns, refunds, replacements, and exchanges are governed by our Return and Refund Policy. Production and delivery information is governed by our Shipping Policy.

8. Promotions and discount codes

Promotions, discount codes, and special offers may be subject to additional terms, including expiration dates, product restrictions, minimum purchase requirements, and limits on combining offers.

Unless otherwise stated, discount codes have no cash value and cannot be applied to previously completed purchases. We may modify or discontinue a promotion where permitted by law.

9. Intellectual property

The website and its contents, including the Young American name, logos, wordmarks, designs, artwork, photographs, videos, graphics, product names, written copy, and website layout, are owned by or licensed to Young American and are protected by applicable intellectual property laws.

You may view and use the website for personal, noncommercial shopping purposes. You may not reproduce, distribute, sell, modify, publish, create derivative works from, or commercially exploit our content without written permission.

No rights or licenses are granted to you except the limited right to use the website in accordance with these Terms.

10. Reviews and submitted content

If you submit a review, photograph, comment, or other content through the website, you retain ownership of your original content. You give Young American a nonexclusive, royalty-free right to use, reproduce, display, and adapt that content in connection with operating and marketing the store, subject to applicable privacy law.

You represent that you have the right to submit the content and that it does not violate another person’s intellectual property, privacy, publicity, or other legal rights.

We may remove submitted content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

11. Prohibited uses

You may not use the website or its content:

For any unlawful, fraudulent, or deceptive purpose
To violate the rights of Young American or another person
To submit false or misleading information
To transmit malicious code or interfere with website security
To collect another person’s information without authorization
To scrape, copy, or systematically extract website content
To impersonate another person or misrepresent your identity
To interfere with another customer’s use of the website
To place fraudulent or unauthorized orders

We may suspend or terminate access when we reasonably believe these Terms have been violated.

12. Third-party services and links

We use third-party providers to operate parts of the store, including ecommerce hosting, payment processing, production, fulfillment, analytics, and shipping.

Your use of certain features may also be subject to the applicable provider’s terms and privacy practices. We are not responsible for the content or practices of independent third-party websites linked from our store.

A link to another website does not constitute our endorsement of that website.

13. Privacy

Our collection, use, and disclosure of personal information are explained in our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other service providers needed to operate the store, process payments, fulfill orders, prevent fraud, provide customer support, and comply with legal obligations.

14. Errors and corrections

The website may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.

We may correct errors and update information at any time. If an error affects an order you have placed, we may contact you to confirm the corrected information or cancel and refund the affected portion of the order.

15. Website availability and warranties

We do not guarantee that the website will always be uninterrupted, secure, or free from technical errors. We may temporarily restrict access for maintenance, security, operational, or other legitimate reasons.

Nothing in these Terms excludes or limits warranties, remedies, or consumer rights that cannot legally be excluded or limited.

16. Limitation of liability

To the fullest extent permitted by law, Young American and its service providers will not be liable for indirect, incidental, special, punitive, or consequential losses resulting from your use of the website or purchase of our products.

For claims relating to a particular order, our total liability will not exceed the amount you paid for the affected order, except where applicable law requires otherwise.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, willful misconduct, gross negligence, personal injury caused by negligence, or applicable statutory consumer rights.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold Young American harmless from third-party claims, damages, and reasonable expenses resulting from your unlawful misuse of the website, your violation of these Terms, or content you submit that infringes another person’s rights.

18. Termination

These Terms remain effective while you use the website.

We may suspend or terminate your access if you materially violate these Terms, engage in fraud or abuse, or threaten the security or operation of the website.

Provisions that reasonably need to survive termination, including those concerning intellectual property, liability, indemnification, and governing law, will remain in effect.

19. Governing law and disputes

These Terms are governed by the laws of the State of Maryland and applicable federal law, without regard to conflict-of-law principles.

This provision does not deprive you of any mandatory consumer protections available under the laws of your state of residence.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms and the policies incorporated into them constitute the complete agreement between you and Young American concerning your use of the website and purchases through the store.
